These terms apply to the use of Flowproof, an online service of Peelmedia. By creating an account you agree to these terms. Please also read our privacy statement.
This is a translation. In case of any difference, the Dutch version prevails.
1. Definitions
- Flowproof: the online service used to scan websites for visibility in AI search engines, including reports, notifications and client reports.
- We or Peelmedia: the provider of Flowproof.
- User or you: the natural person or organisation that creates an account.
- Subscription: the free plan, Pro or Business, with the features and limits as described on the pricing page.
2. Applicability
These terms apply to every use of Flowproof and to every agreement between you and us. Deviations apply only if we have agreed them with you in writing, including by email. The user's general terms and conditions do not apply.
Flowproof is intended for business use. If you use Flowproof as a consumer, the rights that the law gives you as a consumer continue to apply.
3. Account
- When creating an account, you provide correct details and keep them up to date.
- You keep your password secret. You are responsible for what happens through your account.
- You confirm your email address. Without confirmation, we do not send reports and notifications.
- You must be at least 16 years old to create an account.
4. Use of the scan
You may only use Flowproof for lawful purposes. You may:
- scan websites that are publicly accessible, or for which you have the owner's permission.
You may not:
- use Flowproof to overload websites, circumvent security or test systems without permission;
- circumvent the limits of your subscription, for example by creating multiple free accounts;
- resell or copy the service, reports or software, except as Business expressly permits with client reports;
- access the scanner in an automated way outside the features that Flowproof provides for this.
In the event of abuse, we may restrict or terminate your account.
5. Subscriptions and payment
- Prices are shown on the pricing page and are exclusive of VAT, unless stated otherwise.
- Paid subscriptions are paid in advance per month or per year via Stripe and are automatically renewed for the same period.
- You can cancel at any time in your account. A monthly subscription then runs until the end of the current month, an annual subscription until the end of the current year. After that, you revert to the free plan and your reports are kept.
- Amounts already paid are not refunded, unless the law requires this.
- We may change prices. We will notify you of a price change by email at least 30 days in advance and it takes effect at your next renewal. If you do not agree, you can cancel before that date.
- If a payment fails, we may revert your subscription to the free plan.
6. What Flowproof does and does not promise
Flowproof checks technical and content characteristics of a website and gives advice based on public documentation and best practices. We do our best to keep the scan accurate and up to date.
However: AI search engines and search engines decide for themselves which sources they show, and their methods are not public. We therefore do not guarantee any rankings, mentions, citations, traffic or revenue. A high score means that your website has the known requirements well in order. It is not a promise that an AI system will mention you.
The advice is general in nature. You decide for yourself whether and how to apply it. Have far-reaching changes to your website carried out by an expert and make a backup beforehand.
7. Availability and changes
We aim for a well-functioning and continuously available service, but cannot guarantee that Flowproof will always work without interruption or errors. Where possible, we announce maintenance in advance.
We may improve and change Flowproof. If an essential feature disappears from your paid subscription, we will let you know in advance and you can cancel with a refund of the part you have not yet used.
8. Client reports and branding (Business)
With Business you can share reports in your own branding with clients. You are yourself responsible for the logos, texts and data you add, and for the arrangements with your clients. You ensure that you have the right to use those logos and data. A shared link only works as long as your Business subscription is active and you have not revoked the link.
9. Intellectual property
The software, texts, scanning methodology and design of Flowproof belong to us or to our licensors. You receive a non-exclusive, non-transferable right to use Flowproof for as long as your account exists.
You may freely use your scan results and reports for your own website and, with Business, for your clients. The data you enter yourself remains yours.
10. Liability
- Our liability is limited to direct damage. The maximum is the amount you paid for Flowproof in the 12 months before the event causing the damage. For the free plan, this is a maximum of € 100.
- We are not liable for indirect damage, such as lost profit, missed revenue, loss of rankings or mentions, or damage caused by changes you have made to your website based on our advice.
- These limitations do not apply in the event of intent or deliberate recklessness on our part.
- You must report damage to us in writing within one year after you discovered it.
11. Force majeure
We are not liable if we cannot fulfil our obligations due to circumstances beyond our control. Examples include outages at hosting, payment or email providers, internet outages or changes at AI platforms and search engines.
12. Termination
You can delete your account at any time in the settings. Your data will then be deleted as described in the privacy statement. We may terminate or restrict your account if you breach these terms. If we discontinue Flowproof entirely, we will let you know at least 60 days in advance and refund prepaid amounts on a pro rata basis.
13. Changes to these terms
We may change these terms. We will notify you of important changes by email at least 30 days in advance. If you continue to use Flowproof after that, you agree to the new terms. If you do not agree, you can cancel your account before they take effect.
14. Governing law
These terms and the use of Flowproof are governed by Dutch law. Disputes will be submitted to the competent court in the district where Peelmedia is established. This does not affect the rights a consumer has under the law. We always try to resolve a disagreement together first: email us at jelle@peelmedia.nl.
